Who is responsible for the Thorough Examination?
In general, it is the responsibility of the employer of the truck operator to ensure the equipment they are using is safe. If the lifting equipment is leased, or rented on a long-term basis of 12 months or more, the responsibilities are the same as if it was owned outright.
If the truck is on a short-term lease of one day to one year the rental company has responsibility for arranging Thorough Examination. BUT the employer of the truck’s operator has still to satisfy themselves the truck has a valid Report of Thorough Examination. Also, a truck must have the Report of Thorough Examination if it leaves the owners undertaking. This includes if it moves between companies temporarily or on a permanent basis.
